Website Terms and Conditions
Section I
- The Orla Straż (Eaglewatch) Foundation, with its registered office in Bojano (84-207), at ul. Bartników 12, entered in the National Court Register (KRS) under number 0000614995 (hereinafter referred to as the “Foundation”), operates a website at the domain www.orlastraz.org (hereinafter referred to as the “Website”) in accordance with these Terms and Conditions as well as the Terms and Conditions for Donations and Privacy Policy
- The Website operates to pursue and support the statutory activities of the Orla Straż (Eaglewatch) Foundation, including for the purpose of collecting donations to organize charitable assistance in Poland and abroad.
- Donations are collected within the statutory activities of the Foundation.
- Revenues from donations received constitute income from the statutory activities of the Foundation.
- < Terms and Conditions for Donations and Privacy Policy set out the rules for making monetary donations to the Foundation as well as the rules and scope of data processing.
Section II
- The Foundation is the sole owner of the Website.
- The use of the Website is entirely voluntary and free of charge.
- Prior to using the Website, each user should review the provisions of these Terms and Conditions as well as the Terms and Conditions for Donations and Privacy Policy
- By accepting these Terms and Conditions or by using the Website, the user consents to the processing of their personal data by the Orla Straż (Eaglewatch) Foundation, in accordance with the provisions of these Terms and Conditions as well as the Terms and Conditions for Donations and Privacy Policy
- Each user, by using the Website, unconditionally accepts in their entirety the provisions of these Terms and Conditions as well as the Terms and Conditions for Donations and Privacy Policy
- Any exploitation of the Website or any of its parts without the Foundation’s consent is prohibited.
- The Foundation reserves all rights to the Website, the Foundation’s logo, as well as the photographs and videos presented thereon, in accordance with applicable law.
Section III
- The Use of the Website shall not violate applicable law or the provisions of these Terms and Conditions as well as the Terms and Conditions for Donations and Privacy Policy
- To use the Website properly, each user should have technical devices with Internet access and lawful software, including web browsers.
- Users making donations via payment operators shall first review and accept the terms and conditions of the respective payment operator, depending on their choice of service (Przelewy24 or PayPal).
- The Foundation enables users to make one-time and/or recurring donations for the Foundation’s statutory purposes through voluntary selection of a payment operator or via bank transfer to the account details that the Foundation provides on the Website.
- Users may contact the Foundation by email at fundacja@orlastraz.org or by using the contact form.
Section IV
- 1. The Foundation strives to publish content reliably; however, it is not liable for the consequences of any use of such content by users or third parties in an improper manner or in breach of these Terms and Conditions.
- 2. The Website contains links to websites operated by third parties, including fundraising platforms (Siepomaga.pl, Zrzutka.pl, FaniMani.pl), payment operator services (Przelewy24, PayPal), and social media platforms (YouTube, Facebook, Twitter, Instagram). The Orla Straż (Eaglewatch) Foundation is not responsible for the privacy policies of the linked websites and recommends that users review the terms and conditions and privacy policies of such websites/services before use.
Section V
- The Foundation is the data controller. The data controller processes the personal data of users in accordance with applicable law.
- The Foundation processes the personal data of users in accordance with the Privacy Policy (as set out in the Terms and Conditions for Donations and Privacy Policy) solely for the purpose of lawful electronic use of the Website, including making donations and enabling the sending of newsletters to users’ email addresses. Processing of personal data for purposes other than those set out above is possible only after the user gives their consent to the processing of personal data for purposes explicitly specified by the Foundation.
- The user has the right to access their personal data at any time, as well as the right to rectify it and to request its erasure in accordance with applicable law. Details regarding the scope and purposes of data processing and user rights in this regard are set out in the Information Notice.
Section VI
- 1. In connection with the operation of the Website, the following information about users and their behavior is collected and stored:
- in web server logs;
- in Google Analytics data;
- in forms;
- on end-user devices in cookie files.
- The Orla Straż (Eaglewatch) Foundation uses solutions provided by a third-party provider, Google, Inc., with its registered office at 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States, which analyzes anonymous data relating to users visiting the Website through the Google Analytics tool. This tool operates using cookies without disclosing data that enables personal identification. Each user should review the Google Analytics Privacy Policy available at www.google.com/intl/pl_pl/policies/privacy.
Section VII
- Users may file a complaint regarding the functioning of the Website electronically at: fundacja@orlastraz.org or in writing to the Foundation’s registered office address.
- A response to a duly filed complaint shall be issued by the Foundation within 14 days, electronically or in writing, to the address indicated by the user.
- Complaints regarding the functioning of payment operators (Przelewy24 and PayPal) are handled by the respective payment operators in accordance with their own Terms and Conditions.
- Each transaction made via payment operators (Przelewy24 and PayPal) is subject to a fee as indicated in the agreement between the payment operators and the Foundation, the amount of which is subject to trade secrecy.
Section VIII
- The Website uses cookies, which are not used to collect any information about the Website’s users or to track their browsing activity.
- Cookies contain the name of the Website, the storage period on an end-user device, and a unique number. This data is not associated with any specific individuals browsing the Website.
- Cookies do not store any personal data of users.
- Cookies are used for statistical purposes and to maintain a user’s session.
- Cookies are divided into session cookies, stored on the user’s device until they log out or leave the Website, and persistent cookies, stored on the user’s device until deleted by the user or in accordance with the parameters of these files.
- Users may block the storing of cookies by configuring their web browser accordingly. The Help option available in the user’s browser may be useful in this regard.
Section IX
- The Foundation reserves the right to unilaterally amend these Terms and Conditions at any time. Amended provisions shall come into force upon publication.
- These Terms and Conditions come into force from the date of their publication on the Website.
- Matters not regulated by these Terms and Conditions shall be governed by the provisions of generally applicable law, including the Civil Code and the Act on the Protection of Personal Data.
- The court having jurisdiction over any disputes arising from the functioning of the Website shall be the court competent for the Foundation’s registered office.
Information Notice
In accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: “GDPR”), we hereby inform you that:
- The Data Controller of personal data is the Orla Straż (Eaglewatch) Foundation, with its registered office in Bojano (84-207), at ul. Bartników 12, Tax Identification Number (NIP): 5882417442, entered in the National Court Register (KRS) under number 0000614995, email address: fundacja@orlastraz.org (hereinafter referred to as the “Data Controller” or the “Foundation”).
- The Foundation has appointed a Data Protection Officer, who may be contacted regarding all matters relating to the processing of personal data, via email at: fundacja@orlastraz.org.
- Personal data is processed:
- for the performance of the donation agreement, including its technical processing – the Foundation requests that the user provide their first and last name and an email address. In the case of a traditional bank transfer and online payment forms via Przelewy24 and PayPal, the Foundation also processes the bank account number and the address shown in the transfer details;
- for the purpose of complying with the Foundation’s legal obligations – the Foundation processes the information referred to in point (a) above;
- for the purposes of direct marketing of the charitable activities carried out by the Foundation and the promotion of the Foundation’s activities, i.e. sending information about planned promotional and informational events organized by the Foundation, as well as information about the Foundation’s support for persons in need, in written form (traditional paper correspondence) or by email – the legal basis for the processing is Article 6(1)(f) GDPR – the Data Controller’s legitimate interest, consisting in obtaining monetary and non-monetary resources to carry out tasks covered by the statutory public benefit activities of the Orla Straż (Eaglewatch) Foundation; and for the purposes of potentially establishing, asserting, or defending against claims – the legal basis for the processing is Article 6(1)(f) GDPR – the Data Controller’s legitimate interest, consisting in the ability to establish, assert, or defend against claims;
- for the purpose of communicating with donors of the Orla Straż (Eaglewatch) Foundation;
- for the purpose of sending thank-you messages for support provided, by email and/or by post (traditional paper correspondence), confirming the completion of a bank transfer, and maintaining donation statistics – in this regard, the Foundation processes the data set out above, as well as the number and amount of donations made by the user;
- for analytical, statistical, and monitoring purposes – the legal basis for the processing is Article 6(1)(f) GDPR – the Data Controller’s legitimate interest, consisting in maintaining statistics and verifying the proper fulfilment of the Foundation’s objectives, in particular the manner in which monetary and non-monetary resources are used within the framework of monetary and in-kind donations, for the purpose of better tailoring the Orla Straż (Eaglewatch) Foundation’s charitable activities to the needs of persons in need;
- for the purpose of creating a mailing list for marketing purposes – to inform users by email about activities undertaken by the Foundation and to encourage registered users to support the Foundation’s activities and initiatives, including by sending a periodic newsletter – the Foundation processes the user’s first and last name and email address.
- The Orla Straż (Eaglewatch) Foundation may process the personal data of donors in the following categories: basic identification data such as first name, surname, and contact details, including email address, as well as any other data contained in the payment form at www.orlastraz.org or in a traditional or bank transfer order.
- The recipients of users’ personal data may include:
- the Data Controller’s personnel;
- the web solutions provider (hosting services) under a data processing agreement (Zenbox sp. z o.o., with its registered office in Częstochowa (42-200), at ul. Dąbrowskiego 7);
- the accounting office providing bookkeeping services to the Foundation under a data processing agreement (Biuro Rachunkowe Karolina Godzwon, with its registered office in Sopot (81-881), at ul. Kolberga 11)
- the platform providing the Foundation with online marketing solutions (GetResponse S.A., with its registered office in Gdańsk (80-387), at ul. Arkońska 6/A3);
- payment service providers, whose terms and conditions and privacy policies are available at: www.przelewy24.pl and www.paypal.com;
- public authorities or entities entitled to obtain data pursuant to applicable law, e.g. courts, law enforcement agencies, or state institutions, upon submitting a request based on an appropriate legal basis;
- the bank maintaining the Foundation’s bank account (PKO BP S.A., Branch 1 in Sopot (81-754), at ul. Grunwaldzka 45).
- Users’ personal data will not be transferred to countries outside the European Union or the European Economic Area.
- The retention period for personal data depends on the purpose for which the data is processed and is determined based on the following criteria:
- the period resulting from the obligation to archive data pursuant to the provisions of applicable law;
- provisions of law that may require data to be processed for a specified period;
- the period necessary to protect the Data Controller’s interests, including the limitation period for any potential claims against the Data Controller.
- In connection with the processing of their personal data, users are entitled to the following rights:
- the right to request access to users’ personal data from the Data Controller and to receive a copy thereof;
- the right to withdraw consent to the processing of personal data (where consent constitutes the legal basis for processing);/li>
- the right to rectification of personal data;
- the right to erasure of personal data, in particular in the event of withdrawal of consent to their processing, where there is no other legal basis for processing;
- the right to restriction of the processing of users’ personal data;
- the right to object to the processing of personal data, where the sole legal basis for processing is the legitimate interest of the Data Controller and/or the performance of a task carried out in the public interest;
- the right to data portability;
- the right to lodge a complaint with the supervisory authority, namely the President of the Personal Data Protection Office (UODO).
- The provision of personal data and consent to their processing is voluntary; however, refusal to provide such data or consent results in the inability to receive a response to any inquiry submitted to the Orla Straż (Eaglewatch) Foundation by post, email, or via the contact form, as well as the inability to make a monetary donation to the Orla Straż (Eaglewatch) Foundation.
- Users’ personal data will not be processed in a fully automated manner or through profiling.
