Terms and Conditions for Donations and Privacy Policy (Personal Data Processing Policy)

 

These Terms and Conditions set out the rules for making monetary donations to the Eaglewatch Foundation, with its registered office in Bojano (84-207), at ul. Bartników 12, entered in the National Court Register (KRS) under number 0000614995, Tax Identification Number (NIP): 5882417442 (hereinafter referred to as the “Foundation”), and for the processing of personal data in connection with services provided via the website www.orlastraz.org.

 

Section I
General Provisions

 

  1. The Eaglewatch Foundation accepts monetary donations solely for the purposes set out in the Foundation’s Statute.
  2. The Foundation accepts monetary donations by:
    1. using the online payment form functionalities of Przelewy24.pl, operated by PayPro S.A., with its registered office in Poznań (60-327), at ul. Kanclerska 15, entered in the National Court Register (KRS) under number 0000347935, and of PayPal, operated by PayPal (Europe) S.à r.l. et Cie, S.C.A., Société en Commandite par Actions, with its registered office in Luxembourg (L-2449), at 22–24 Boulevard Royal, R.C.S. Luxembourg B 118 349, made available on the website www.orlastraz.org (hereinafter referred to as the “Payment Operators”);
    2. making direct payments to the Foundation’s bank accounts with the following numbers:
      • 06 1020 1853 0000 9102 0294 3074 – for payments in PLN,
      • 35 1020 1853 0000 9802 0294 3082 – for payments in EUR,
      • 40 1020 1853 0000 9602 0294 3090 – for payments in USD,
      • 80 1020 1853 0000 9602 0436 3032 – for payments in NOK,
      • 19 1750 0012 0000 0000 3411 9414 – for payments in GBP,
    3. public collections organised in accordance with the provisions of the Act on the Rules for Conducting Public Collections, dated 14 March 2014.
  3. All payments and in-kind donations are voluntary and constitute a donation within the meaning of Article 888 et seq. of the Civil Code.
  4. Monetary donations are non-refundable.
  5. The www.orlastraz.org website allows users to:
    1. make monetary donations to support the Foundation’s statutory activities,
    2. subscribe to the Foundation’s mailing list; where a donation is made, the user thereby consents to being added to the Foundation’s mailing list.
  6. The user may withdraw their consent to subscribe to the Foundation’s mailing list at any time by submitting a request by email to fundacja@orlastraz.org.
  7. Before using the services provided on the website www.orlastraz.org, the user is required to review these Terms and Conditions. By using the services, the user confirms that they have read and understood these Terms and Conditions, accept their provisions, and agree to comply with them.
  8. The current version of these Terms and Conditions is published on www.orlastraz.org under the title: Terms and Conditions for Donations and Privacy Policy.
  9. The Foundation reserves the right to unilaterally amend these Terms and Conditions at any time. The amended provisions shall take effect upon their publication at the link available on the website www.orlastraz.org.

 

Section II a
Donations via the Przelewy24 payment form

 

  1. Upon using the Przelewy24 online payment form, each user is required to comply with the provisions of these Terms and Conditions as well as the Przelewy24 terms and conditions available at www.przelewy24.pl.
  2. Any amendments to the Przelewy24 terms and conditions are determined by the Payment Operator.
  3. To make a donation via Przelewy24 online payment form, once the user has completed the form available at www.orlastraz.org, the user is redirected to the Przelewy24 service.
  4. The user may make payments via:
    1. electronic transfers,
    2. BLIK,
    3. payment cards.
  5. By completing the payment form and thereby using the Przelewy24 service, the User consents to the processing of data, including the personal data provided in the form, for marketing purposes, pursuant to Section III of these Terms and Conditions.
  6. By making a donation using the Przelewy24 online payment form, the User undertakes to comply with the Przelewy24 terms and conditions and consents to the processing of personal data by the Payment Operator as a separate data controller, in accordance with the rules set out by the operator.

 

Section II b
Donations via the PayPal payment form

 

  1. Upon using the PayPal online payment form, each User is required to comply with the provisions of these Terms and Conditions as well as the PayPal terms and conditions available at www.paypal.com.
  2. Any amendments to the PayPal terms and conditions are determined by the Payment Operator.
  3. To make a donation via PayPal online payment form, once the user has completed the form available at www.orlastraz.org, the user is redirected to the PayPal service.
  4. The user may make payments via:
    1. PayPal account,
    2. payment cards.
  5. By completing the payment form and thereby using the PayPal service, the User consents to the processing of data, including the personal data provided in the form, for marketing purposes, pursuant to Section III of these Terms and Conditions.
  6. By making a donation using the PayPal online payment form, the User undertakes to comply with the PayPal terms and conditions and consents to the processing of personal data by the payment operator as a separate data controller, in accordance with the rules set out by the operator.

 

Section III
Privacy Policy and Personal Data Processing Rules

 

  1. The controller of the personal data of the user of the www.orlastraz.org website is the Eaglewatch Foundation, with its registered office in Bojano (84-207), at ul. Bartników 12, entered in the National Court Register (KRS) under number 0000614995, Tax Identification Number (NIP): 5882417442, e-mail address: fundacja@orlastraz.org (hereinafter referred to as the “Controller” or the “Foundation”).
  2. Personal Data of the user is processed:
    1. for the performance of the donation agreement, including its technical processing – the Foundation requests that the user provide their first and last name and an email address. In the case of a traditional bank transfer and online payment forms via Przelewy24 and PayPal, the Foundation also processes the bank account number and the address shown in the transfer details;
    2. for the purpose of complying with the Foundation’s legal obligations – the Foundation processes the information referred to in point (a) above;
    3. to send a transfer confirmation and thank-you messages for the support, and to maintain statistics on payments – the Foundation processes the data referred to above, as well as the number and amount of donations made by the user;
    4. for the purpose of creating a mailing list for marketing purposes – to inform users by email about activities undertaken by the Foundation and to encourage registered users to support the Foundation’s activities and initiatives, including by sending a periodic newsletter – the Foundation processes the user’s first and last name and email address.
  3. Providing personal data is voluntary. However, failure to provide it makes it impossible for the user to make a monetary donation to the Foundation.
  4. The legal basis for the processing of the user’s personal data is the user’s consent, given explicitly or by making a monetary donation. In addition, the legal basis for the processing of personal data is the necessity to comply with the Foundation’s legal obligations and the Foundation’s legitimate interests.
  5. The user’s personal data is also processed by the following entities:
    1. on the basis of a data processing agreement – Zenbox sp. z o.o., with its registered office in Częstochowa (42-200), at ul. Dąbrowskiego 7, providing website services to the Foundation;
    2. under a data processing agreement – Biuro Rachunkowe Karolina Godzwon, with its registered office in Sopot (81-881), at ul. Kolberga 11, providing accounting services to the Foundation;
    3. under a data processing agreement – GetResponse S.A., with its registered office in Gdańsk (80-387), at ul. Arkońska 6/A3, providing the Foundation with online marketing solutions;
    4. separate controllers:
      • payment service providers (Przelewy24 and PayPal); their terms and conditions and privacy policies are available at: www.przelewy24.pl and www.paypal.com;
      • the bank maintaining the Foundation’s bank account – PKO BP S.A., Branch 1 in Sopot (81-754), at ul. Grunwaldzka 45.
  6. The Foundation stores the user’s personal data in electronic form, including on servers operated by its IT system provider, on computers owned by the Foundation, on USB flash drives or external hard drives, and on mobile phones. In addition, such data is stored in paper form.
  7. The user’s personal data will not be processed in a fully automated manner, including through profiling.
  8. Personal data will be processed for a period ending upon the expiry of the limitation period for claims and obligations arising from the agreement with the Controller.
  9. The user’s personal data will not be transferred to any country outside of the European Economic Area.
  10. The user has the right to access their personal data processed by the Foundation, to rectify it, to request its erasure, to request restriction of processing, to object to the processing of their personal data, and to data portability.
  11. The user has the right to submit a complaint to the President of the Personal Data Protection Office if their personal data is processed in breach of the law.

Section IV
Complaints

 

  1. Complaints related to the service provided may be submitted via email to fundacja@orlastraz.org or by traditional mail to the Foundation’s registered office.
  2. The Foundation will review the complaint and inform the user of how it has been resolved by email within 14 (fourteen) days from the date of receipt of the complaint.
